The dispute revolves around three alleged patent infringments MercExchange say the ebay “Buy It now” feature contravenes their longstanding patents, and in a previous ruling were awarded eight-figure damages. EBay asked for the patent to be re-examined, and the US Patent Office has now released its ruling, concluding that the patent applications in question were invalid. MercExchange are expected to appeal. The case is an interesting example of how the patent system quite obviously doesn’t work when related to software or the internet, in our opinion.
